How is my data processed on the platform?

The City of Brussels is responsible for processing your data on the citizens’ platform; the City complies with all applicable data protection obligations, in particular Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data (the General Data Protection Regulation - GDPR) and the Law of 30 July 2018 on the protection of natural persons with regard to the processing of their personal data.

What data is processed, by whom is it processed and for what purposes?

The creation of an account on the City's platform entails a number of data processing operations which relate to you personally:

  • Your electronic card information is used during your connection to check your identity. This processing is carried out by the federal identification service of the FPS Policy and Support (FPS BOSA).
  • The Identification information relating to the management of your account on the platform.
  • The login information for your account on the various pages of the platform is processed for security and statistical purposes; this is information is processed anonymously. You can modify certain aspects of the collection of your connection data, specifically via the platform's cookies policy.
  • The data you send to us via our forms, such as:
    • Application forms for deeds, certificates and criminal record extracts;
    • Application forms for the renewal of your parking permit;
    • Application forms for contesting fines and fees;
    • Contact forms;
    • Application forms to request Newsletters,
    • etc.
  • The official documents for which you submit an application. These documents are directly available in your citizen space; they include:
    • Your civil status records, which are automatically transmitted from the Database of Acts of the Civil Registry managed by FPS Interior.
    • Your certificates and extracts from the population registers, which are automatically transmitted from the National Register and the Population Register, managed by FPS Interior.
    • Your criminal record extracts, which are automatically transmitted from the Central Criminal Record, managed by the FPS Justice.

In what legal framework is this data collected and/or made available by the City of Brussels?

  1. As part of the City's public interest role and the City's legal obligations: this concerns the issuing of deeds, extracts and certificates, but also all forms enabling the City to fulfil its public role with regard to parking and the local police.
  2. On the contractual basis: the City offers services on the platform that you can choose to use or not. In some cases, the provision of certain services is subject to the processing of your data. This concerns, inter alia, newsletters and the text message reminder service for renewing parking permits.
  3. Subject to your consent: any data processing that is not included in activities of public interest and that does not derive from services offered by the City shall be subject to your explicit consent.

How much control do you have over your data on the platform? What are your rights with regard to this data?

In compliance with European regulations (GDPR) and its Belgian implementing law, you have rights over the data which concerns you. These rights are:

  • A right of access and information: you have the right to request information regarding the processing of your data and to request access to this data.
  • A right to erasure: you can request that this data is deleted. Please note, this right may be limited when data processing is necessary for the City to carry out its obligations and public interest role. If the data is necessary for the implementation of a service offered by the City, the deletion of the data would sometimes amount to a waiver of this service.
  • A right to limitation and opposition: insofar as there are no compelling and/or legitimate reasons for the data processing, you can request the suspension and termination of this data processing.
  • A right to portability: apart from the data processing which is necessary for the City to carry out its public interest role, you can request that your data be sent to you in a structured machine-readable format and/or to another data controller.

In order to facilitate the exercise of these rights, the platform has been designed to offer you the greatest control over the data. Thus, you can access all your data by logging into your space; you can print or download this data; you can report any errors that you see and you can erase the data that you no longer want to see in your space.

Please note, however, that the deletion of your data on the online space does not mean the total deletion of all this data.

You can also always delete your account. In this case, all your data will be deleted, including the data you submitted to create your account.

How long does your data stay on the platform?

Unless you delete it, your data shall be kept on the platform.

Please note, the deletion of your data in the online space does not mean the permanent deletion of all your data. Certain data must be kept on our servers or in the public archives in order to allow the City to carry out its public interest role. In addition, deeds, certificates and extracts from databases external to the City (e.g.: DACR, Central Criminal Record Office, National Register) will always exist in these databases.

The legal retention periods shall be applied to this data; to check the duration period, we ask you to consult the City’s privacy policy and the public authorities responsible for the data.
